Update legislation: Commencement of Fixed Rental Contracts Act

The 'Fixed Rental Contracts Act' proposed by the PvdA and the ChristenUnie, aimed at abolishing temporary rental contracts, has been passed by the Senate. Nevertheless, its implementation cannot take place before January 1, 2024.

Effective Fixed Rental Contracts Act

The private member's bill 'Fixed Rental Contracts Act' from the PvdA and the Christian Union, which aims to abolish temporary rental contracts, has been adopted by the Senate. Nevertheless, its implementation cannot take place before January 1, 2024.

As members of the Association of Rental Agents Amsterdam VVA, we use different contract models:

- Model A: An indefinite contract with an initial rental period of 12 months.

- Model B: A fixed-term contract, with a maximum duration of 24 months.

- Model C: A fixed-term contract, with the intention that the owner will live in his home again.

 

The adopted law will abolish the familiar Model B, making it no longer possible to offer fixed-term contracts for rental. However, there are exceptions, it is allowed for:

- Students who live in the Netherlands for a temporary period.

Landlords may terminate the rent if close family want to move into the home. Temporary rental with the intention to return to home (Model C). Temporary rental to students who temporarily live in the Netherlands.

However, this applies to new rental contracts; existing temporary rental contracts remain in force unchanged.

The exact date of entry into force of the new legislation is not yet known, but it is expected to be July 2024.
